OSWSA® TERMS AND CONDITIONS
Scope of application
The following general terms and conditions apply only to distance selling contracts between the company OS-Western Sports Apparel, Raiffeisenstr. 5, 86494 Emersacker and their customers (consumers within the meaning of Section 13 of the German Civil Code or entrepreneurs within the meaning of Section 14 of the German Civil Code). If individual provisions are expressly related to consumers or only to entrepreneurs, they only apply to them.
Deviating terms and conditions only apply if they have been expressly recognized and confirmed by the seller.
The contract language is German. The law of the Federal Republic of Germany shall apply unless mandatory law in the consumer's country of origin conflicts with this.
Product description
The product images serve to illustrate the goods offered. Colors, size and quality of the image can be influenced by the screen quality and the settings made. It is therefore not the illustration that is decisive, but the product description.
Errors and misprints are reserved.
Offer, conclusion and storage of the contract
Information on our website represents non-binding offers to place an order.
To conclude a purchase contract, the customer places a binding order and the seller sends him a written contract confirmation or the ordered goods. As soon as the customer receives the contract confirmation, the contract is effectively concluded.
The automatic confirmation of the receipt of the order does not represent acceptance of the contract offer by the seller. If a purchase contract is not concluded at the latest three weeks after receipt of the order, the customer's order is deemed to have been rejected.
The seller reserves the right to withdraw from the contract in the event of missing or untimely delivery to himself. However, he will only make use of his right of withdrawal if he is not responsible for the impossibility to deliver. In this case, he will inform the customer immediately and declare his withdrawal.
We store your order data internally for processing the contract. However, they cannot be accessed by you via us. You will receive a confirmation of the contract with the content of the contract within a reasonable period of time after the conclusion of the contract, at the latest with the delivery of the goods.
Payment, delivery
Our delivery area includes Europe - without Norway - and Switzerland. Delivery to other countries only after prior request and agreement.
We only deliver from a minimum order value of € 50.00
We deliver to other European countries and Switzerland only against advance payment. Payment can be made via Paypal or credit card payment.
Shipments to PO Boxes or poste restante shipments are not possible.
Unless a different delivery time is specified in the item description or a different delivery time has been expressly agreed, the following applies:
Within Germany, the delivery takes place 3 working days (Monday to Saturday) after payment in advance, after the day on which you instructed the payment to your bank. When purchasing on account, the delivery takes place 3 working days (Monday to Saturday) after the day on which you received the declaration of acceptance. For deliveries to all other countries according to e), the delivery period according to sentence 2 is extended by two weeks.

Prices, shipping costs
All prices are given in euros (€), including the statutory value-added tax.
Deliveries are made within Europe - excluding Norway and Switzerland.
The following shipping costs are added to the goods prices.
We do not ship via last name.

Switzerland: € 25.00 plus applicable customs duties.

Return, environmental protection, sustainability
If you make use of your right of withdrawal, you bear the direct costs of returning the goods.
Please think a little about our environment and the long distances that a product has to travel anyway. Only order goods that you really want to keep and avoid selection shipments. Please read our product information carefully and use the size tables for comparison! Of course, we are happy to give you product information by phone or email.
We make every effort to produce our quality products in the most environmentally friendly way possible, taking sustainability into account. Please support us with your selection care and also protect our environment with short distances!
For hygienic reasons, our caps cannot be exchanged!
Retention of title
All goods remain our property until full payment. The customer is not entitled to dispose of the goods as an owner beforehand.
Warranty, guarantee, customer service
The statutory warranty claims apply
Insofar as guarantee promises are advertised for individual goods, the guarantee conditions result from the information in the product description and the respective link via which you can access the guarantee conditions of the guarantor. Guarantee commitments apply in addition to the statutory warranty claims and do not limit them.
Warranty claims from contracts with companies within the meaning of § 14 BGB expire after 1 year for new goods, they are excluded for used goods.

Place of jurisdiction
The court responsible for the seller's registered office is agreed as the exclusive place of jurisdiction for all claims arising from contracts with companies within the meaning of Section 14 of the German Civil Code.
